Terms of Service

1. Acceptance of Terms

By accessing or using BRRRR.Solutions ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all visitors, users, and account holders.

2. Description of Service

BRRRR.Solutions provides free and subscription-based tools for real estate investors, including:

• Investment property analysis calculators (Rental Analyzer, Rehab Evaluator, BRRRR Calculator)
• Deal pipeline tracking for potential acquisitions
• Portfolio management for owned properties
• Document storage for property-related files
• Automated notifications for document expiry dates
• Market research tools (subscription feature)

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice.

3. Informational Purpose Only

• Calculator results are mathematical estimates based on inputs you provide. Actual investment outcomes will vary.
• DSCR, cash-on-cash return, cap rate, and other metrics shown are estimates and do not guarantee loan qualification or investment performance.
• BRRRR.Solutions does not originate, broker, or fund mortgage loans.
• Market data and rent estimates, where provided, are aggregated from third-party sources and may not reflect actual market conditions.
• You should consult a licensed real estate agent, mortgage professional, financial advisor, and/or attorney before making any real estate investment decision.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and not share account credentials
• Promptly notify us of any unauthorized account access at support@brrrr.solutions
• Be responsible for all activity that occurs under your account
• Be at least 18 years of age
• Use the Platform only for lawful purposes

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription Services

Certain features require a paid subscription. By subscribing:

• You authorize recurring charges to your payment method at the subscription rate selected
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel at any time; cancellation takes effect at the end of the current billing period
• We do not provide refunds for partial billing periods except where required by law
• We reserve the right to change subscription pricing with 30 days notice to active subscribers

6. Document Storage

BRRRR.Solutions provides document storage as a convenience feature. You acknowledge:

• You are solely responsible for maintaining backup copies of all documents you upload
• BRRRR.Solutions is not responsible for document loss due to technical failures, account termination, or service discontinuation
• You must only upload documents you own or have legal rights to store
• Storage limits apply per subscription tier and may change with notice
• We reserve the right to remove documents that violate these Terms or applicable law

7. Notification Services

Document expiry notifications are provided as a convenience. You acknowledge:

• Notification delivery is not guaranteed and may be subject to email deliverability issues
• You remain solely responsible for monitoring your own policy and lease expiry dates
• BRRRR.Solutions is not liable for losses resulting from missed or failed notifications
• You may opt out of notifications in your account settings at any time

8. Partner Referrals

BRRRR.Solutions may connect you with third-party lending, insurance, or real estate service providers:

• Referrals to third parties are made only with your explicit consent
• We do not guarantee the quality, availability, or pricing of any third-party services
• Third-party providers have their own terms and privacy policies that govern their services
• BRRRR.Solutions may receive compensation for successful referrals
• We are not responsible for the actions or omissions of third-party service providers

9. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Platform or its systems
• Scrape, crawl, or extract data from the Platform without written permission
• Upload malicious files, viruses, or harmful code
• Impersonate any person or entity or misrepresent your affiliation
• Use the Platform to send unsolicited communications
• Interfere with or disrupt the Platform's infrastructure
• Attempt to reverse engineer any portion of the Platform

10. Intellectual Property

All content on the Platform — including calculators, code, design, text, graphics, and branding — is owned by BRRRR.Solutions or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Platform content without our written permission.

You retain ownership of all data and documents you upload to the Platform. By uploading content, you grant us a limited license to store and process that content solely to provide the Platform's services to you.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BRRRR.SOLUTIONS DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Platform.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BRRRR.SOLUTIONS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless BRRRR.Solutions and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Maricopa County, Arizona, except that either party may seek injunctive relief in court for intellectual property violations.

15. Changes to Terms

We may update these Terms at any time. We will notify registered users of material changes by email and post the updated Terms with a new effective date. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

16. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with reasonable notice. You may delete your account at any time from your account settings. Upon termination, your right to use the Platform ceases immediately. Sections 10-14 survive termination.
